the short version

  • You need to be 13 or older to make a birthday site or leave a card.
  • Be kind. No harassment, nothing sexual, nothing illegal, and only photos you're allowed to share.
  • What you post stays yours. You let us show it on the birthday site it was made for, and that's all we use it for.
  • Paid plans are a one-time payment per birthday, never a subscription.
  • Changed your mind? Ask within 14 days of paying for a full refund.
  • Anyone can report a card. We remove what breaks these rules.

who we are

Birthdayland ("we", "us") makes group birthday websites: a host sets one up, friends add cards from a link, and the birthday person gets a board and an island made of them. These terms are the agreement between you and us when you use birthdayland.kevinliu.studio or any birthday site on it. Questions about them go to k.bowen.liu@gmail.com.

who can use it

  • You must be 13 or older to make a site, sign in, or leave a card. We ask when you make a site and when you stick a card; please answer honestly.
  • If you're under 18, you need a parent's or guardian's OK to buy a plan.
  • Birthdayland isn't made for children under 13. If we learn that a child under 13 has given us information, we delete it. A parent can ask us to at k.bowen.liu@gmail.com.
  • Don't use Birthdayland if the law where you live says you can't.

hosts, friends and the birthday person

The host makes the site and signs in to run it. The host chooses who gets the link, can hide or delete any card on their site, and is responsible for using the site the way these terms describe. Friends leave cards from the link without an account. The birthday person is who the site celebrates. A host can only make a site about someone who'd be happy to have one: no sites meant to mock, shame or target a person.

what you can and can't post

A card is a message to one person, seen by everyone with the link. Don't post anything that:

  • harasses, bullies, threatens or demeans anyone, or attacks people for who they are;
  • is sexual or pornographic, or shows nudity. Anything that sexualises a child is never allowed: we remove it, keep what the law requires, and report it to the National Center for Missing & Exploited Children (NCMEC);
  • shows or encourages violence, self-harm or anything illegal;
  • shares someone else's private information (an address, a phone number, documents) or photos of people who wouldn't want them shared;
  • you don't have the right to share, like someone else's photos, art or music;
  • pretends to be someone you're not, spams, or links to scams or malware.

Don't try to break, overload or get around the limits of the service, or get into sites, accounts or data that aren't yours.

your content stays yours

You own what you post. By posting it, you give us permission to store it, copy it as needed to run the service (for example to make smaller versions of a photo), and show it on the birthday site you posted it to, to anyone with that site's link, for as long as it's on the site. That permission ends when the card or the site is deleted, except for copies in our backups, which are gone within 30 days, and anything the law requires us to keep. We don't sell your content, and we don't use it to advertise.

Hosts: the site is yours to run. A paid site's host can download every card as a ZIP. Friends' cards still belong to the friends who made them, so share the download the way they'd expect.

reports and takedowns

Every card on a birthday site has a report button. Reports are anonymous. When 3 different people report the same card, it's hidden until someone has looked at it. We review reports, and we can hide or remove content, pause uploads, or suspend a site that breaks these rules, without notice when the problem is serious. Hosts can hide or delete any card on their own site at any time, except a card we've hidden after reviewing it: that one stays as it is until we're done with it.

Copyright: if something on a birthday site uses your work without permission, email k.bowen.liu@gmail.com with the work, where it appears (the site's address and the card), your contact details, a statement that you believe in good faith the use isn't authorised, and a statement, under penalty of perjury, that your notice is accurate and you're the owner or allowed to act for them. We'll take it down and tell the person who posted it.

plans and payment

Every site starts free. A host can pay once to give one birthday site more room. Prices are in US dollars:

  • Sketch (free): up to 5 cards and 500 MB of photos and video. It takes new cards until 30 days after the birthday, and after that it turns read-only (see how long sites stay up, below).
  • Party ($19 USD, paid once): up to 50 cards and 3 GB of photos and video. It takes new cards until one year after the birthday, and after that it stays up as a read-only archive for good.
  • Milestone ($39 USD, paid once): up to 10,000 cards and 15 GB of photos and video. It takes new cards until 2 years after the birthday, and after that it stays up as a read-only archive for good.

A plan belongs to one birthday site and can't be moved to another. Moving from Party to Milestone costs only the difference ($20). Friends never pay. Payments are processed by Stripe; we never see or store your card number. Your plan starts when Stripe confirms the payment, usually within seconds. Prices can change, but never for a site that's already paid. Bespoke (a look made by hand for one person) isn't sold through the site: get in touch.

refunds

  • Ask within 14 days of paying, at k.bowen.liu@gmail.com, and we'll refund you in full. After that, ask anyway: if something on our side went wrong, we'll make it right.
  • A refund takes the site back to the free plan. Nothing is deleted: if the site holds more cards than the free plan allows, it turns read-only, so every card stays on the board but no new ones can be added.
  • If you dispute a payment with your bank instead of asking us, the site is frozen while the dispute is open.

how long sites stay up

  • Sketch: takes cards until 30 days after the birthday, then turns read-only. The free plan doesn't promise to keep a site forever: before we ever remove a read-only free site we email its host first, with time to download what's on it or upgrade.
  • Party: takes cards until one year after the birthday, then stays up read-only as an archive. We keep it until the host deletes it.
  • Milestone: takes cards until 2 years after the birthday, then stays up read-only as an archive. We keep it until the host deletes it.

A host can delete their site at any time. A deleted site disappears at once and can be restored for 30 days; after that we remove it, its cards and its files for good. The privacy notice has the details.

the service itself

We work hard to keep every birthday site up, especially on the day, but we can't promise it will never be down, slow or lose something. Birthdayland is provided as it is, without warranties beyond what the law requires. We may change or improve features; if a change takes away something you paid for, we'll make it right.

As far as the law allows, we're not responsible for indirect or unexpected losses, and our total responsibility to you for anything to do with Birthdayland is limited to what you paid us for the site in question, or $20 if you paid nothing. Some places don't allow these limits; where they don't, they don't apply to you.

ending things

You can stop using Birthdayland whenever you like: delete your card from the device you made it on, ask the host to remove it, or ask us. Hosts can delete their sites. We can suspend or remove a site or block access if these terms are broken, or if we have to for legal reasons. If we ever shut Birthdayland down, we'll give hosts of paid sites at least 60 days' notice and a way to download their cards.

changes to these terms

If we change these terms in a way that matters, we'll say so on this page and, for hosts, by email before the change takes effect. The date at the top says when they last changed. Questions: k.bowen.liu@gmail.com.
